Privacy

The customer's contact information may be used to contact the customer when necessary. Only Rackio has access to your personal information. We reserve the right to contact you regarding technical and non-technical support, account status, billing notifications, account renewal, changes, to any Rackio product and service offerings.

IP Addresses and Domain Names

If you register, renew, or transfer one or many domain names through Rackio, we will submit the request to our domain name services provider (the “Registrar”) on your behalf. Rackio is not responsible for any errors, omissions, or failures of the Registrar. Rackio is responsible to advise their domain names customer of any renewals that are past due. Rackio is not responsible for any domain name not included, missing, or not specified by the customer to be managed by Rackio. Your use of domain name services is subject to the applicable legal terms of the Registrar.

Force Majeure

Any event or circumstance, including, without limitation to, any natural, technological, political or governmental occurrence after a transaction; neither party will be liable for these causes. Force Majeure will not be used in calculating excess downtime.

Rackio Help Desk

Refers to the Rackio personnel responsible for providing Infrastructure operations support services to resolve availability problems, defects and outages.

Application Environment

The software, database and ancillary components required to operate application programs are not supported by Rackio.

Downtime

Any downtime due to application issues is not included in any excess downtime calculations.

Excess Downtime

Refers to any unscheduled downtime that exceeds allowed monthly downtime and that is due to an outage caused by Rackio hardware, software or personnel.

Incident Report

A document issued by Rackio which contains information about each outage and defect occurring over a specific period of time. The information includes the following elements about each outage and defect: date and time of occurrence, description, cause, duration, action taken to resolve the problem and any further action required.
